Welcome to Fold. We (“Fold”, “we”, “our”, or “us”) hope you find the platform useful. By accessing or interacting with our website, mobile application (“App”), servers, or any associated services, listings, or content (collectively, “Fold”), you agree to these Terms of Service (“TOS”). Fold is a privately operated platform owned by Fold Works, Inc.
If you are using Fold on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to this TOS. If you do not agree to the TOS, you are not authorized to use Fold or download the App.
We may modify the TOS at any time, at our sole discretion. You are responsible for reviewing updates. Continued use of Fold constitutes acceptance of the revised TOS. Our Privacy Policy, Prohibited Items/Content Policy, and any other rules or policies referenced on Fold are incorporated into this TOS.
Subject to your compliance with the TOS and (1) being of legal age and capacity to use Fold, or (2) binding a business entity to the TOS, we grant you a limited, revocable, non-exclusive, non-transferable license to use Fold.
You agree not to display, frame, copy, distribute, license, or sell content from Fold without our express written consent, except for content you post.
By posting content on Fold, you grant us a perpetual, irrevocable, worldwide, fully paid, sublicensable license to use, copy, display, distribute, and create derivative works from your content.
Unless expressly authorized by us in writing, you agree not to:
Use or provide software or services that interact with Fold (other than general-purpose browsing/email tools).
Scrape, crawl, harvest, copy, or extract data or content from Fold.
Misuse or interfere with Fold’s systems, moderation tools, security, or user accounts.
Post misleading, unlawful, harmful, fraudulent, or prohibited content.
Create, buy, or sell Fold accounts.
Collect information about Fold users without their explicit consent.
Circumvent Fold’s moderation actions, technical protections, or access controls.
Reverse engineer, decompile, or modify the App or any Fold software.
Use Fold in any way that violates federal, state, or local laws, including but not limited to homestead-related regulations, livestock sales requirements, animal health certifications, transport laws, or food-byproduct regulations.
Fold is only an online marketplace. Fold connects buyers, sellers, renters, rental owners, customers, and service providers, but Fold is not a party to any transaction, rental agreement, or service agreement.
You acknowledge and agree that:
Rental agreements exist solely between the equipment owner and the renter.
Service agreements exist solely between the customer and the service provider.
Fold does not supervise, monitor, or participate in any transaction, rental, or service beyond providing the platform itself.
Fold does not inspect equipment and does not supervise services.
Fold does not guarantee any listing or user.
Fold does not verify that any listing is accurate, complete, or current.
Fold does not guarantee the quality, safety, legality, availability, or fitness for any particular purpose of any listing, item, animal, rental, or service.
This Marketplace Status section applies to every category on Fold, including Food, Livestock, Farm Stand, Garden, Supplies, Equipment, Services, and Rentals.
Fold is a listing platform only.
Transactions happen off-platform and between buyers and sellers directly.
You acknowledge and agree that:
Fold does not broker transactions, handle goods, or certify seller claims.
Fold does not verify compliance with federal or state laws regarding animals, raw milk, eggs, meat, or other regulated products.
Users are 100% responsible for ensuring their own compliance with USDA, state agricultural departments, raw milk laws, transport regulations, and all other relevant legal requirements.
Fold is not responsible for the legality, quality, safety, or condition of any goods or animals listed.
This applies equally to sellers who display a “Verified by Fold” badge. See Section 6 (Verified by Fold) for what Verified status does and does not represent.
Fold allows users to list equipment, tools, vehicles, and other items for rent (“Rental Listings”). With respect to Rental Listings, you acknowledge and agree that Fold does not:
own, possess, or control any rental equipment;
inspect, maintain, or certify any rental equipment;
guarantee that rental equipment is safe, functional, or legal to rent or operate;
verify maintenance records, service history, or the condition of any rental equipment;
verify any license, permit, or registration required to rent, own, or operate the equipment;
verify the qualifications of any renter or operator;
provide, require, or draft rental agreements between owners and renters;
collect, hold, or provide security deposits;
provide escrow services for any rental transaction;
provide insurance covering rental equipment, renters, owners, or third parties; or
mediate disputes between rental owners and renters.
As noted above, Fold does not provide or require rental agreements. Users are responsible for determining whether a written agreement is appropriate for their transaction, including any terms covering condition, use, deposits, damage, late returns, or liability.
Fold allows users to list farm, homestead, agricultural, and related services (“Service Listings”), including but not limited to equipment operation, fencing, land clearing, tractor work, and similar services. With respect to Service Listings, you acknowledge and agree that Fold does not:
employ, engage, or supervise any service provider;
endorse or recommend any service provider;
guarantee the workmanship, results, timeliness, or completion of any service;
guarantee the qualifications, training, or experience of any service provider;
conduct background checks, criminal history checks, or reference checks on any service provider;
screen, verify, or confirm a service provider’s experience, licensing, certifications, or insurance, unless expressly and specifically stated otherwise on Fold;
guarantee scheduling, availability, or completion of any service; or
mediate disputes about the performance or quality of any service.
Customers hiring a service provider through Fold do so at their own risk and are solely responsible for vetting the provider before hiring them.
Fold does not provide insurance, does not verify insurance, and makes no representation regarding whether any user carries insurance of any kind.
Rental owners are solely responsible for determining whether insurance is appropriate or required by applicable law for the item they list for rent.
Service providers are solely responsible for determining whether insurance is appropriate or required for their business, trade, or profession.
Renters are responsible for determining whether adequate insurance exists before renting equipment.
Customers are responsible for determining whether a service provider carries appropriate insurance before hiring them.
In addition to the responsibilities described elsewhere in this TOS, users are solely responsible for:
verifying the identity of the other party to any transaction, rental, or service;
inspecting rental equipment before use and determining whether it is safe to operate;
operating any rental equipment safely and in accordance with its instructions and all applicable law;
returning rented equipment as agreed with the owner;
vetting and hiring qualified service providers, including confirming qualifications, licenses, permits, and certifications where appropriate or required;
following all applicable local, state, and federal laws relating to any transaction, rental, or service; and
entering into their own rental or service agreements, as appropriate, to govern the terms of their transaction.
You agree not to post or attempt to post prohibited content, including but not limited to:
Illegal items or services
Animals or goods restricted by federal/state law
Misrepresented animals (health, lineage, vaccinations, etc.)
Items violating USDA, FDA, or state agricultural rules
Fraudulent, misleading, harmful, or deceptive listings
Spam, scams, or mass advertising
Harassment, hate speech, or unsafe content
Data-collecting posts, phishing, or identity misuse
Fold may moderate, remove, block, re-categorize, delay, or restrict content or accounts at our discretion. Nothing we say or do limits our right to moderate (or not).
Fold provides an in-app messaging system to help buyers and sellers communicate about listings.
You acknowledge and agree that:
Messages sent through Fold may be stored to operate the platform, provide customer support, investigate suspected abuse or fraud, enforce this TOS, comply with legal obligations, and improve platform safety.
Authorized Fold personnel may access message content when reasonably necessary for moderation, abuse prevention, legal compliance, security investigations, or customer support.
Access to user messages is limited to legitimate business purposes, logged where appropriate, and restricted to authorized personnel.
Fold is not a party to any transaction and is not responsible for the content of messages exchanged between users.
Certain listings or features may require paid fees.
By submitting a paid posting, you authorize us to charge your account.
All fees are non-refundable, including for moderated or removed posts, except as expressly provided in Section 6 (Verified by Fold).
Taxes may apply.
We reserve the right to reject any posting.
“Verified by Fold” (“Verified”) is an optional paid membership program intended to help buyers identify trusted, established members of the Fold community.
Verified is available to eligible sellers who subscribe to a paid Verified plan.
Payment begins the verification application process. Payment alone does not guarantee approval.
Every application is manually reviewed by a member of the Fold team.
Fold may approve or deny any application at its sole discretion.
Verified is offered on annual and monthly subscription plans.
Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
You may cancel your subscription at any time. Canceling prevents future renewals but does not immediately remove your Verified status or access.
If you cancel, your Verified benefits remain active through the end of your current paid billing period, after which your subscription will not renew and Verified status will end.
If your application is denied, Fold will issue a full refund of your payment and cancel the associated subscription.
If your application is approved, you may request a full refund within 30 days of approval. After this 30-day period, subscription fees are non-refundable. You may cancel your subscription at any time to prevent future renewals, and your Verified benefits will remain active until the end of your current paid billing period.
Fold may suspend or remove your Verified status at any time, including if:
your subscription expires, lapses, or is canceled;
your account violates this TOS or any Fold policy;
Fold discovers fraudulent, false, or misleading information in your application or account; or
Fold determines, in its sole discretion, that your account no longer meets the requirements for verification.
Verified status is a trust and visibility signal only. It does not guarantee sales, buyer inquiries, marketplace success, or any particular search or feed ranking or placement.
Verified sellers may receive increased visibility, but placement in search results and the feed is determined by multiple factors and may change over time.
Verified by Fold is a trust and identity program — not a regulatory certification.
Verified status does not:
certify that a seller complies with any federal, state, or local law or regulation; or
constitute a business license, food safety certification, agricultural certification, inspection, legal endorsement, or guarantee of regulatory compliance of any kind.
As described in Section 2, Fold does not verify regulatory compliance for any listing, Verified or not. Sellers remain solely responsible for understanding and complying with all applicable laws, regulations, permits, licenses, inspections, labeling requirements, and other legal obligations related to the products or services they offer. Buyers should perform their own due diligence before making a purchase, regardless of a seller’s Verified status.
To the full extent permitted by law, Fold and its officers, employees, agents, contractors, licensors, and affiliates (“Fold Entities”):
Make no warranties or representations about Fold, including availability, accuracy, completeness, reliability, or security.
Provide Fold “AS IS” and “AS AVAILABLE.”
Disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Are not responsible for the actions, omissions, listings, goods, animals, equipment, rentals, services, communications, or conduct of users, rental owners, renters, service providers, or customers.
Without limiting the foregoing, Fold Entities are not liable for any Claims (defined in Section 8) arising from or related to Rentals or Services, including but not limited to Claims involving personal injury, death, property damage, equipment failure, mechanical defects, unsafe equipment, unsafe services, poor workmanship, negligence of any user, theft, loss, delayed returns, missed appointments, livestock injuries, animal-related incidents, crop damage, agricultural losses, business interruption, financial loss, contract disputes, warranty disputes, insurance disputes, payment disputes, or user misconduct. These matters are solely between the parties involved in the transaction, rental, or service.
To be clear, Fold is not responsible for and does not mediate refunds, deposits, cancellations, late returns, damage claims, or payment disputes between users. These are resolved directly between the parties to the transaction, rental, or service.
Fold Entities are not liable for any direct, indirect, incidental, consequential, or special damages, including loss of profits, data, goodwill, or personal/property damage related to Fold or any transaction that occurs through Fold.
This disclaimer applies in full to Verified sellers and Verified listings — see Section 6 (Verified by Fold) for the scope and limitations of Verified status.
In no event shall our total liability exceed $100 or the total amount you paid us in the previous 12 months, whichever is greater.
Some jurisdictions limit such disclaimers; portions may not apply to you.
All claims, disputes, or causes of action (“Claims”) arising out of or relating to Fold shall be governed by the laws of the State of Tennessee (or your preferred jurisdiction), except where overridden by federal law.
Claims shall be resolved exclusively in courts located in Columbia, Tennessee, unless we seek injunctive relief elsewhere.
You agree to:
Submit to the personal jurisdiction of these courts.
Indemnify, defend, and hold harmless Fold Entities from any third-party Claims arising from your use of Fold, violations of this TOS, or any Rental or Service transaction — including but not limited to Claims arising from rental transactions, service transactions, injuries, property damage, contract disputes, insurance disputes, user negligence, regulatory violations, misrepresentations, equipment failures, or service failures.
Accept responsibility for any Claims brought against your employees, agents, contractors, or affiliates arising from their use of Fold under your direction or benefit.
Fold, the Fold logo, and any other Fold branding are trademarks of Fold Works, Inc. You may not use them without written permission.
This TOS is the entire agreement between you and Fold.
If any term is deemed unenforceable, it shall be modified to the minimum extent necessary to remain enforceable.
Fold’s silence or inaction regarding a violation does not waive our rights.
The sections on Use, User Communications, Verified by Fold, Disclaimer, Liability, and Claims & Indemnity survive termination.
The English version of this TOS controls over any translations.
